If for any reason a claim proceeds in court rather than through arbitration, both you and East Coast Wings waive any right to a jury trial. This class action waiver does not apply to any claims brought under the California Private Attorneys General Act (PAGA) or any similar state statute, to the extent such statutes prohibit waiver of those rights.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Small claims court actions within the applicable jurisdictional limits are also excluded from mandatory arbitration.
